General Terms and Conditions of Use of the "www.plasticorigins.eu", "www.trashroulette.com" websites and of the Plastic Origins mobile application, and management of personal data collected

These General Terms and Conditions apply to websites « www.plasticorigins.eu » and « www.trashroulette.com » (here after referred as « Websites ») and mobile app Plastic Origins in its Android® and iOS® versions (here after referred as « Mobile app »).

In accordance with the law, we invite you to read these conditions of use (here in after the "Conditions"). These Terms relate to your legal rights and responsibilities applicable when you use these Sites or this Application.

The Sites and the Application are made available to you for your personal or professional use, subject to compliance with the Conditions defined below.

By accessing these Sites and downloading, visiting and / or using the Application, you acknowledge that you have read, understood and agree to be bound by these Terms, as well as agreeing to agree to comply with all applicable laws and regulations. If you do not agree to these Terms, please do not use these Sites and the Application.

The Sites and the Application are intended to collect and display data relating to the state of pollution of rivers in France and Europe. The targeted pollution is pollution by waste and in particular plastic waste. The data allows alerting the territories concerned by this pollution and to propose them solutions of waste reduction at the source.

The content of this notice may change ; we therefore invite you to consult it very regularly by checking the date of its last update.

Legal information

The Sites and the Application are published by the association established under the French law 1901, Surfrider Foundation Europe, whose registered office is at 33, allée du Moura - 64200 Biarritz - France, whose SIRET number is 38873422000055.

The site's publication director is Mr. Florent Marcoux, Director of the association.

The content is hosted by the Azure service of Microsoft France, SAS with a capital of € 4,240,000, whose head office is at 34 quai du Président Roosevelt - 92130 Issy-les-Moulineaux, registered with the Trade and Companies Register under the SIRET number 32773318400516.

Intellectual property

All data collected (photos, videos, waste location data) via the Application by users are the property of Surfrider Foundation Europe, except for the personal data of users, i.e. their names, first names, emails and years of birth. These are the subject of special attention by Surfrider Foundation Europe (see paragraph "management of personal data").

By creating an account on the Site www.trashroulette.com and uploading photos to this Site, users are informed that they are ceding their copyright on these same photos to Surfrider Foundation Europe. These Conditions constitute a contract for the transfer of copyright. Personal data linked to the user account is the subject of special attention by Surfrider Fondation Europe (see paragraph "management of personal data"). The labeling of images on this site may in no case give rise to any financial compensation from Surfrider Foundation Europe. All labeling work is done on a voluntary basis by users. The labeled images will be shared by Surfrider Foundation Europe under a Creative Commons CC BY-SA 4.0 license. This license allows the use and sharing of this data by third party legal or natural persons under condition of sharing under the same conditions. The author, Surfrider Foundation Europe, must be cited in any sharing.

All information and data appearing on the Sites and the Application are the property of Surfrider Foundation Europe which also publishes them under a Creative Commons license CC BY-SA 4.0.

Limitation of liability and exclusion of warranty

Surfrider Foundation Europe makes every effort to ensure that the information displayed on the Sites and Applications is accurate and up to date, reserving the right to modify the content at any time and without notice. However, they cannot guarantee that this information is complete, nor that it will not be modified by a third party (hacking, virus). Surfrider Foundation Europe also declines any responsibility (direct or indirect) in the event of delay, erroror omission in the content and use of these pages, as well as in the event of interruption or unavailability of the service.

Surfrider Foundation Europe can in no way be held liable for any direct or indirect damage resulting from or subsequent to the dissemination by a third party of a virus through its Sites or its Application. Likewise, Surfrider Foundation Europe cannot be held liable for any material or incidental damage (including, but not limited to, technical failure, loss of data), nor for any other indirect damage, what so ever occurring during or related to the use of the Sites or the Application.

Management of personal data

Each user of the Application remains in control of his personal data. You can, at any time, contact Surfrider Foundation Europe to consult, modify or delete your personal data.

As responsible for processing the personal data of users of the Application, Surfrider Foundation Europe undertakes to process them in a transparent, confidential and secure manner, in accordance with the Data Protection Act of 6 January 1978 as amended and with the Regulations. (EU) general on data protection of April 27, 2016 ("GDPR").

This personal data management policy may be modified, supplemented or updated at any time, in particular in order to comply with any legal, regulatory, jurisprudential or technical development. Users' personal data will always be treated in accordance with the policy in effect at the time of their collection.

Types of personal data collected when creating an account on the Application: name, first name, email address, year of birth, password (stored in a hash format), type of profile (individual, aquaticenvironment manager, municipality, nautical club, volunteer surfrider chapter, other).

The user's attention is drawn to the fact that, during its operation, the Application collects location data. The recording of this location data is the basis on which the waste monitoring protocol is based.

Surfrider Foundation Europe does not use cookies to analyse user behaviour when visiting its Sites and the App.

Processing purposes

The personal data of users is used to identify the origin of data relating to pollution by waste. They allow Surfrider Foundation Europe to ensure the quality of the data received and to verify that each user has been previously trained by the association. The year of birth of the users gives Surfrider Foundation Europe an idea of the average age of the volunteers carrying out the follow-ups, allowing it to refine its discourse and the services offered on the Sites and the Application.

The email addresses collected may be used to send information and updates about the project, including results. By using the application, the user consents to the use of his/her personal data for these purposes.

Waste pollution data collected through the App is used to map plastic pollution in rivers and rivers in Europe, to identify the most polluted areas and to track the evolution of this pollution over time.

This mapping and the data related to it are used by Surfrider Foundation Europe teams to carry out local actions in order to reduce plastic pollution of rivers. In this context, Surfrider Foundation Europe can communicate this data to local actors who can act to reduce this pollution.

Moreover, for the purpose of prevention and action, Surfrider may publish on the website "plasticorigins.eu", "surfrider.eu" as well as all open data platforms or other communication channels the data relating to waste pollution collected via the Application under the CC BY-SA 4.0 license.

The images captured by the Application or uploaded by users to the site www.trashroulette.comareused to train the artificial intelligence algorithm to detect the presence of waste on the banks of rivers and streams.

Duration of Data Storage

The data collected in the framework of the project is kept for a period equal to the need for processing and will be used and stored until the end of the project.

Rights of users and subscribers

In accordance with current European regulations, users have the following rights:

  • Right of access (article 15 RGPD) and rectification (article 16 RGPD), update, completeness of data
  • Right to erasure of data (Article 17 GDPR) when they are inaccurate, incomplete, equivocal, out of date, or whose collection, use, communication or storage is prohibited
  • Right to withdraw consent at any time (article 13-2c RGPD)
  • Right to limit data processing (article 18 GDPR)
  • Right to object to data processing for legitimate reasons (article 21 GDPR)

Applicable law

The Sites and the Application are governed by French law. These conditions will be interpreted in accordance with French law. Visitors with access to the Sites and the Application from abroad, must ensure compliance with locally applicable laws.
